PTUN Side with Semanggi Victims in Lawsuit Against Attorney General Burhanuddin

TEMPO.CO, Jakarta - The Jakarta State Administrative Court (PTUN) on Wednesday granted the lawsuit against Attorney General Sanitiar Burhanuddin filed by the 1998 human rights tragedy victims’ families.

In the verdict, the administrative court deemed the statement made by the attorney general in a meeting with Commission III of the House of Representatives (DPR) on January 16, 2020, was a violation of the law committed by a government body or official.

The attorney general at the time claimed that the Semanggi I and Semanggi II bloody incidents were not considered as severe human rights violations. Sanitiar Burhanuddin also said the national commission on human rights (Komnas HAM) should not have followed up the incidents due to the lack of sufficient reasons to form an ad hoc tribunal.

The PTUN Jakarta’s verdict requires the defendant to issue a statement related to the handling of the Semanggi human rights violation which reflects the actual circumstances at the time. The defendant must also report the actual situation in the next DPR's Commission III hearing and pay a small fine of Rp285,000.
