Judicial Review Trial on KPK Law to be Held Today

TEMPO.CO, Jakarta - The Constitutional Court (MK) will hold a preliminary trial of judicial review on the Corruption Eradication Commission or KPK Law challenged by students from various universities at 08:30 a.m., Monday, 30 September.

Represented by an advocate Zico Leonard Djagardo Simanjuntak, some 18 students submitted the suit as they considered the law defective formally and materially, albeit it has not been inked by President Joko “Jokowi” Widodo and enacted in the state gazette yet.

The court spokesman Fajar Laksono said the trial will still be held since the suit had been registered. “We will later see in the preliminary hearing, whether the court will rule us to wait until the next trial or others,” Fajar told Tempo, Sunday, September 29.

Zico Simanjuntak previously detailed the lawsuit formally and materially to be submitted to the court. He said the plaintiffs questioned the process of the law revisions making which was not under the procedure as it was not listed in the national priority legislation program (Prolegnas).

They also questioned the plenary meeting on September 17 in which the KPK revisions law was ratified. The session was reportedly attended by 80 lawmakers, but the House speaker Fahri Hamzah said there were 289 council members present.

Zico further explained that his side doubted the law-making process that did not involve the public. The KPK itself was not invited to the discussion. "In establishing a law, relevant institutions should be included," said Zico as reported by Antara on Friday, September 20.
