MK Holds Tax Amnesty Judicial Review

TEMPO.CO, Jakarta - The Constitutional Court (MK) held the first hearing for a judicial review of the recently passed Tax Amnesty Law on Wednesday, August 24, 2016.
The Indonesian People’s Struggle Union questioned a number of articles set forth in the new law.
“Pleaders viewed that the provisions have injured the public’s sense of justice because they are discriminative,” the pleaders said in a press release in Jakarta on Wednesday, August 24, 2016.
Leni Indrawati, who appealed the judicial review said that the law was not in line with the constitution providing an authority to tax institutions to enforce the tax responsibility.
“With such provisions, tax institutions will have no teeth, and they can even be compromised,” she added.
The One Justice Foundation said that the Tax Amnesty Law had degraded the nature of the taxation system from being forceful to being compromised.
In the first hearing, the panel of judges suggested revisions to the appeal. Constitutional Court judge Dewa Gede Palguna called on the pleaders to improve their legal standing as governed under article 51 of the Constitutional Court. Another judge said that the legal standing of the appeal made by an individual must be clarified.
