TEMPO.CO, Jakarta - As the Constitutional Court (MK) gears up to announce the ruling on the election result dispute case, political analysts are coming out with predictions on what the outcomes might be.
An expert on constitutional law from Brawijaya University, Ali Syafaat, predicts the MK will reject the lawsuit in its entirety, as the Court fails to find evidence of massive, structural and systematic violations in the election process alleged by Prabowo-Hatta's advocacy team.
"The testimonies of witnesses and experts from the Prabowo-Hatta team will not help them win the suit in court," Ali told Tempo on Wednesday, August 20, 2014. "I predict that the MK will not rule in favor of Prabowo-Hatta."
Former MK justice Maruarar Siahaan said that it would be hard for MK to rule in favor of Prabowo-Hatta as the arguments made by their advocacy team did not indicate any structural, systematic and massive fraud in the election. Instead, the violations pointed out are more of an administrative nature. "They see these administrative faults as fatal mistakes of the General Elections Commission (KPU)."
Similarly, the director of the Association for Election and Democracy (PERLUDEM), Titi Anggraini, said Prabowo's chances of winning the suit was slim to none. "Up to this point, their advocacy team has failed to present convincing evidence to support their vote- rigging allegations," said Titi at a discussion in Menteng, Central Jakarta on Tuesday, August 19, 2014.
According to Titi, Prabowo's chances of having MK overturn the KPU's announcement was remote at best, because the violations alleged by Prabowo was merely administrative and were localized in a small number of areas. "The possibility of proving such violations is small and it is not likely to change the outcome of the election," said Titi.
