HTI to Consult with MK after Perpu Ormas Passage into Law

TEMPO.CO, Jakarta - Hizbut Tahrir Indonesia (HTI) will consult with the Constitutional Court (MK) after the passage of the Regulation in Lieu of Law No. 2/2017 on Mass Organization (Perppu Ormas) into law. HTI spokesman Ismail Yusanto said that the organization expects the hearing of a judicial review of the regulation to continue.
HTI filed for a judicial review of Perpu Ormas with the Constitutional Court on July 18. The day after, the government revoked HTI’s legal entity status.
The House of Representatives (DPR) yesterday agreed to pass Perpu Ormas into law. HTI views that the passage could have an impact on the judicial review with the MK. The organization may have to file another application for a judicial review since the object is no longer the Perpu, but the new law.
The government issued Perpu Ormas to protect the country’s sovereignty from those wanting to promote ideologies that are against Pancasila [five principles]. HTI is being disbanded on that ground.
Many have criticized the new regulation as it could threaten democracy. In Law No. 17/2013 on Mass Organizations, the government was required to file mass organization disbandment through judicial proceedings. In the new law, the disbandment may immediately be done by the Justice and Human Rights Ministry and Home Affairs Ministry.
