TEMPO.CO, Jakarta – Coal mining company Berau Coal Energy (IDX: BRAU) is preparing to sue national businessman Rosan P. Roeslani at the Singapore International Arbitration Centre (SIAC). Berau director Sambodo Amir said the company has lawyers and witnesses ready to face Rosan—their former CEO—in court.
Berau and its holding company, Asian Resource Minerals Plc.—formerly Bumi Plc—officially filed for arbitration against Rosan in Singapore on January 20. "The first hearing will be on August 25," Sambodo told Tempo yesterday.
The dispute began Berau accused Rosan of embezzling US$173 millions while serving as Berau's president director. Some of these funds were placed in Chateu Asset Management. The company said that Rosan did not keep his promise to transfer funds or assets worth US$173 million, that was due on September 26 and December 26, 2013.
"For him not to have paid the money is the same as default, ergo we are taking this to arbitration," said Amir.
When Tempo contacted him yesterday, Rosan was reluctant to respond about the particulars of the case. "I cannot talk about it now, it's not the time to talk to the public," he said.
