KPK Must Take Responsibility for Lukas Enembe's Death, Lawyer Says

TEMPO.CO, JakartaThe attorney for Lukas Enembe, Petrus Bala Pattyona, said the Corruption Eradication Commission or KPK must be responsible for the death of the former governor of Papua. Petrus claimed that, by law, sick people should not be tried.

"Of course, he was sick. According to the law, sick people cannot be tried," Petrus said when met at the Sentosa Funeral Home of Gatot Soebroto Central Army Hospital (RSPAD) on Tuesday, December 26.

Petrus said that the temporary suspension of Lukas Enembe due to health reasons to Gatot Soebroto Army Hospital was issued on October 23, 2023. "Since October. Since the High Court Judge stated that Mr. Lukas must be treated until he recovered," he said.

According to the data Tempo obtained, Lukas Enembe's pre-trial detention suspension file was issued by the Supreme Court through the General Judicial Body of Jakarta High Court's Directorate General, with the number 6684/PAN.W10.U/HK.2.2/XI/2023.

With the death of Lukas Enembe, Petrus Bala Pattyona said that legal action could no longer be taken because the deceased's rights and obligations had ended.

"The decision that was to be implemented automatically expires because of the defendant's death," he said.

Lukas Enembe died on Tuesday morning, December 26. He was a convict in a bribery and gratification case. At the first hearing, the court sentenced him to 8 years in prison and a fine of Rp500 million. On appeal, the Jakarta High Court raised his prison sentence to 10 years and the fine to Rp1 billion.
