Wilmar and 15 Other Cooking Oil Producers Sue Trade Minister Zulkifli Hasan

TEMPO.CO, Jakarta - Dozens of cooking oil producers filed a lawsuit against Trade Minister Zulkifli Hasan at the State Administrative Court (PTUN) on September 18, 19, and 20, 2023. Based on the court’s case tracking information system page, the case is still under preliminary examination.
The first lawsuit numbered 471/G/TF/2023/PTUN.JKT was registered on Sept. 18 by five companies, namely PT Wilmar Nabati Indonesia, PT Multimas Nabati Asahan, PT Sinar Alam Permai, PT Multi Nabati Sulawesi, and PT Wilmar Bioenergi Indonesia.
It is classified as a lawsuit against the government's administrative actions or factual actions. However, the court’s information system could not yet display the details of the case.
The second lawsuit was registered on Tuesday, Sept. 19, as a lawsuit against the government’s administrative action or factual action with case number 472/G/TF/2023/PTUN.JKT.
The companies suing the Trade Minister are PT Musim Mas, PT Agro Makmur Raya, PT Intibenua Perkasatama, PT Musim Mas-Fuji, PT Mike Oleo Nabati Industri, PT Wira Inno Mas, and PT Megasurya Mas. The court's information system was also unable to display the details of the case.
On September 20, 2023, four other producers of cooking oil registered the case number 473/G/TF/2023/PTUN.JKT. They are PT Permata Hijau Palm Oleo, PT Nubika Jaya, PT Pelita Agung Agroindustri, and PT Permata Hijau Sawit.
When met at the Trade Ministry’s building, Zulkifli claimed he had not yet been informed of the lawsuits. “Perhaps it is because the Attorney General's Office names [the companies] as suspects, so the regulation is challenged to drop the suspect status. Perhaps that’s the case,” the minister said, adding that they have the right to file the lawsuits.
As previously reported, Wilmar Group, Musim Mas, and Permata Hijau have been named as corporate suspects for alleged corruption in palm oil or CPO export permits. They allegedly received benefits from CPO export permits which violated regulations. The Attorney General's Office recorded that the losses reached Rp6.47 trillion.
Meanwhile, Director General of Domestic Trade Isy Karim said he had not yet received a summons from the court. Nevertheless, he emphasized that the Trade Ministry would follow the applicable legal process. “We will prepare it later, we will follow it,” Isy said at the Trade Ministry building on Friday, September 22, 2023.
