TEMPO.CO, Jakarta - A total of 10 civil society organizations filed a formal judicial review to the Supreme Court regarding Government Regulation or PP No. 124 of 2021 concerning the Capital for the Land Bank Agency.
The 10 organizations are the Consortium for Agrarian Reform (KPA), Indonesian Human Rights Committee for Social Justice (IHCS), Indonesian Forum for the Environment (WALHI), Lokataru Foundation, Indonesian Farmers Alliance (API), Indonesian Organic Alliance (AOI), Ecosoc Rights, FIAN Indonesia, the People's Coalition for Food Sovereignty (KRKP), and Sawit Watch.
KPA Secretary General Dewi Kartika said that the lawsuit was a follow-up to the formal and material lawsuit for Government Regulation No. 64 of 2021 concerning The Land Bank Agency which was registered on Monday, February 13, 2023.
"We hope that the Supreme Court will accept our request for a formal review and declare that Government Regulation No. 124 of 2021 concerning Capital for Land Bank Agency violates the constitution," Dewi told reporters, on Friday, February 17, 2023.
Dewi explained that the appeal was based on the Constitutional Court's ruling No. 91/PUU-XVIII/2020, Law No. 12 of 2011 on the Formation of Legislation, and Law No. 30 of 2014 on Government Administration.
"PP No. 124 of 2021 was issued after the Constitutional Court's decision, which is clearly a violation because it noted that the government was not allowed to issue any new regulations related to the Job Creation Law," said Dewi.
However, Dewi argued that Joko Widodo or Jokowi's government and the House of Representatives (DPR) have violated the constitution by continuously issuing derivative regulations on the Job Creation Law. “That's why we are formally disputing it because this is a violation of the constitution."
