144 BUMN Breach Employment Law

TEMPO.CO, Surabaya - Some 144 state-owned companies (BUMN) have been deemed violating employment regulation on outsourcing. The Indonesia Workers Association president, Jaya Santosa, said all of those BUMNs have one million employees that consist of 250,000 outsourcing workers.
"Around 90 percent of the 250,000 work in BUMN's core business. This violates the regulation," Jaya told Tempo yesterday.
Based on employment regulation, outsourcing workers should have been promoted to permanent employees. The House of Representatives (DPR) has even instructed for all outsourcing workers to be promoted by May 12, 2014.
DPR commission IX member, Rieke Dyah Pitaloka, said many BUMNs violate this regulation. The outsourcing system currently used is a practice of modern slavery.
Article 59-66 of Employment Regulation explicitly states outsourcing workers are only allowed for five types of works: security, cleaning service, transportation, catering and supporting services in mining. Those are not even a company's core business or perennial works. "Most companies that violate this regulation are BUMN," Rieke said.
Labor issues are proof of Susilo Bambang Yudhoyono administration's failure. "This is the failure of SBY, along with his ministers," said Rieke. Although they are BUMN, they still have to obey the employment regulation.
