KPK Accuses SBY of Having a Political Agenda

TEMPO.CO, Jakarta - Busyro Mugoddas, the Corruption Eradication Commission (KPK) Deputy Chairman, accused President Susilo Bambang Yudhoyono of using the Criminal Law Procedures Code (KUHAP) revision for his political purposes. "The head of state is also the chairman of a political party, he must have a political agenda with the bill," Busyro told Tempo in his office on THursday, February 27, 2014.


Busyro said that Yudhoyono, through his spokesperson, Julian Aldrin Pasha, had often stated that he had no intention to weaken the KPK through the KUHAP revision. However, the government is letting the KUHAP revision draft to be discussed at the House of Representatives (DPR). He is worried that there would be a conflict of interest in the regulation.


The government submitted the draft for KUHAP revision to the DPR early last year, which calls for substantive changes in the criminal procedural law. One of the changes includes the regulation that wiretapping, the most effective method to entrap a corruptor, must be done with a judge's approval. Another crucial change supported by the DPR is the abolition of an authority to investigate the initial stage of the corruption investigation.


Like the KPK, the Police have also expressed their objection in abolishing the initial investigation. Meanwhile, the Supreme Court (MA) stated that the clause prohibiting the Chief Justice to sentence a more severe punishment than the court verdict, could potentially cause injustice.
