Jakarta Administration Loses Lawsuit in Faulty Bus Case

TEMPO.CO, Jakarta - The Indonesian National Board of Arbitration (BANI) has ruled against the Jakarta administration, ordering the city to pay PT Ifani Dewi Rp7.6 billion (US$584,600) related to the procurement of a Transjakarta bus offered to the city in 2013.

“We’re waiting for the Jakarta administration to settle the payment within 40 days,” PT Ifani Dewi lawyer Boyamin Saiman told Tempo on Friday, April 24, 2015.

Boyamin added that the Central Jakarta District Court will execute the ruling if the city refuses to settle the payment within 40 days. One option for the City administration to settle the payment was to allocate a budget in 2014 fiscal year.

“The ruling was lighter than the charge, demanding the city to pay a due fine with a total payment of Rp8.2 billion (US$603,700),” Boyamin explained.

According to Boyamin, the payment for the bus was stalled when the faulty buses case was highlighted in 2014.

Jakarta Governor Basuki “Ahok” Tjahaja Purnama said that he would not hastily comply with the ruling and has planned to review it.

“We respect [the ruling], but I want to review it first after receiving the copy,” Ahok said at City Hall.

According to Ahok, the Attorney General Office earlier found price mark up for each bus in 2013, causing a state loss of Rp54.3 billion (US$4.17 million).

“If the payment was canceled due to price mark up, it means it’s not our fault,” Ahok said.
