TEMPO.CO, Jakarta - The former CEO of Garuda Indonesia Emirsyah Satar was found guilty in the corruption case of CRJ-1000 and ATR 72-600 aircraft procurement at Garuda Indonesia.
"The defendant Emirsyah Satar was found guilty of committing a criminal act of corruption," read the verdict on Corruption Court today, Wednesday, July 31, 2024. The court sentenced Emirsyah to 5 years imprisonment and a Rp500 million fine.
Emirsyah was proven to have committed an unlawful act. He submitted the procurement plan for Garuda Indonesia's fleet to Soetikno Soedarjo as a commercial advisor to Bombardier and Avions De Transport Regional (ATR). The procurement plan was then delivered to the Bombardier manufacturer.
Emirsyah was also proven to have changed the aircraft procurement plan from 70 seats to 90 seats without the board of directors’ approval. He conspired with Soetikno to win Bombardier and ATR in the procurement despite their incompatibility with Garuda’s business model which focuses on full service.
As a result, the state suffered significant losses, totaling US$609.81 million or around Rp9.93 trillion. Previously, on May 8, 2020, Emirsyah was also sentenced to 8 years in prison and an Rp1 billion fine and ordered to pay compensation of SG$2.11 million in a bribery and money laundering case.
Emirsyah Satar was found guilty of violating Article 2 (1) in conjunction with Article 18 of Corruption Law in conjunction with Article 55 (1) 1 of the Criminal Code and Article 3 in conjunction with Article 18 of the Corruption Law in conjunction with Article 55 (1) 1 of the Criminal Code. This verdict adds to the long list of corruption cases involving former SOE officials in Indonesia.
