TEMPO.CO, Jakarta - Land brings with it a plethora of interests, which often come with unlawful practices due to lack of supervision and lackluster legal enforcement. One of these practices is the infamous land mafia.
But what exactly is a land mafia?
Citing an article entitled Mafia Tanah Menurut Kebijakan Undang-Undang Pertanahan (Land Mafia According to Land Law) in 2020, land mafia is a land-related crime involving a group of people aiming to own or dominate someone else's land. The perpetrators often use well-planned and systematic methods.
The land mafia is intertwined with the lack of state protection for its people. The Agrarian Law No. 5 of 1960 provided that the state must provoke a sense of land security for its owners.
According to siplawfirm.id, there are multiple methods to unlawfully own a piece of land, including using fraudulent documents and statements, fake transactions, and corruption.
The Ministry of Agrarian Affairs and Spatial Planning has special concerns with land mafia issue, due to its criminal nature. In addition, the Criminal Code provided under Article 263 (1) and (2) that fraudulent document is punishable by law.
One of the measures carried out by the Ministry of the Complete and Systematic Land Registration Program or PTSL, and the digitalization of mortgage deeds, land value zone, land registration, and others.
Victims of the land mafia, the land rights holders, and their families are allowed to take the legal route by reporting it to the police.
