Indonesia to Partake in Advisory Opinion on Palestine at International Court of Justice

TEMPO.CO, Jakarta - Indonesia recently reiterated its support for Palestine and will participate in the investigation of human rights violations happening in Gaza. This was conveyed by Foreign Affairs Minister Retno Marsudi at a high-level event on the human rights situation in Palestine on Tuesday, Dec. 12, in Geneva, Switzerland.
“Here, in this building, at this very moment, it is very relevant for us to discuss the situation in Gaza and how we can make a difference for humanity and human rights,” Retno said at the event, which was held on the occasion of the 75th anniversary of the Universal Declaration of Human Rights, or also known as Human Rights Day.
She called on countries to push for an immediate and lasting ceasefire in Gaza, to reject double standards in upholding human rights, and to support the accountability mechanisms, which are currently underway by the Independent International Commission of Inquiry established by the United Nations Human Rights Council.
Retno also called on countries to document violations, provide evidence, lend political support, and allow the Commission full access to carry out its mandate to investigate human rights violations in the Palestinian territories.
The Commission was established in 2021, following a special session on May 27, 2021, on the serious human rights situation in the occupied Palestinian territories, including East Jerusalem.
Minister Retno confirmed that Indonesia would participate in the proceeding of the Advisory Opinion regarding Palestine at the International Court of Justice (ICJ).
An advisory opinion is legal advice given by the ICJ to the UN or a specialized agency under Article 96 of the UN Charter. It is stipulated that both the General Assembly and the Security Council may request advisory opinions from the ICJ "on any legal issue."
“Various accountability mechanisms related to Palestine must go beyond business as usual and we must ensure due follow-up of all these processes,” Retno Marsudi stressed.
