Protesters to Hold Rally Amidst Job Creation Act Lawsuit Hearing at Constitutional Court

TEMPO.CO, Jakarta - A thousand protestors consisting of farmers and workers are reported to demonstrate in front of the Constitutional Court of Indonesia on Thursday, July 6, 2023. This protest will escort the follow-up trial on the formal review of Law No. 6 Year 2023 on the Stipulation of Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation. The hearing was initially to be held on June 21, 2023, to hear the testimony of President Joko Widodo and the House of Representatives. 

The farmers gathering tomorrow are a coalition of members of the Consortium for Agrarian Reform (KPA), from the Sundanese Peasant’s Union (SPP), Indramayu Peasant’s Union (STI), Cianjur  Peasant’s Association (PPC), Suryakencana Sukabumi Peasant’s Association, and Banten Peasant’s Movement. Meanwhile, the workers are members of the KASBI Confederation from Jakarta, Banten, and West Java.

It is known that KPA and KASBI Confederation along with the Constitutional Rights Defenders Committee (Kepal) which are consisted of 14 civil organizations have filed for a Formal Judicial Review of Law No. 6 Year 2023 on Job Creation (Job Creation Act) toward the Constitutional Court. According to them, the enforcement of the Job Creation Act created an abundance of negative impacts on the livelihood of farmers and workers.

In the agricultural sector, KPA noted that some implementations of the Job Creation Act worsen the livelihood of farmers, fishermen, and indigenous people. Meanwhile, in the labor sector, KASBI Confederation noted some negative impacts of the Act, such as the increased limit on working hours in Fixed-Term Employment Contracts (PKWT) and the extermination of work limitations on outsourcing.

From a regulation perspective, Job Creation Act is considered the government’s betrayal of the Constitution. Thus, KPA and KSBI Confederation submit to the Constitutional Court for a fair and just decision, on the side of the constitution and the people.
