PKS Outlines Rules in Job Creation Perpu That Detriments Worker

TEMPO.CO, Jakarta - Mardani Ali Sera, a legislator from the Prosperous Justice Party or PKS faction conveyed a number of points in the Government Regulation in Lieu of Law or Perpu No. 2 of 2022 concerning Job Creation that is detrimental to workers. The religious party is one of the parties objecting to the House of Representatives’ (DPR) decision to enact the Perpu into a law.
“If we look closely, we can find the weakening of workers’ position in the Job Creation Perpu, including a decline in the amount of layoff compensation, the expansion and ease of layoffs, unrestricted outsourcing," Mardani, a member of DPR Commission II, told Tempo, on Friday, February 17, 2023.
Mardani also said the Perpu expanded and extended the Employee Agreement for a Specific Period (PKWT) system.
Apart from that, the Perpu eases the recruitment of foreign workers, allows low wages, eliminates sectoral wage obligations, weakens the position of the wage council, and weakens the existence of trade unions or labor unions or company partners to construct collective labor agreements.
"PKS's commitment to defending and protecting workers continues to be presented because for PKS, defending workers/weak parties is an ideological and constitutional struggle that will be accounted for in this life and the hereafter," Mardani remarked.
Recently, the DPR brought the Job Creation Perpu to the plenary session to be ratified into law. This decision was taken at a DPR Legislative Body’s (Baleg) meeting on Wednesday, February 15, 2023.
Of the nine factions in the DPR, seven factions agreed and two factions rejected the Perpu, namely the Democratic Party and PKS. The Regional Representatives Council (DPD) also voiced rejection of this Perpu.
The Democratic Party considered the issuance of the Job Creation Perpu as a form of blatant defiance of President Joko "Jokowi" Widodo against the Constitutional Court's ruling which had declared the Job Creation Law conditionally unconstitutional.
