Non-Physical Sexual Harassment Punishable Under Sexual Violence Bill

TEMPO.CO, JakartaActs of non-physical sexual harassment are officially acknowledged as a crime overseen by the draft bill on sexual violence criminal acts or RUU TPKS, which was recently passed by legislators at a House of Representatives (DPR) plenary session on Tuesday, April 13, 2022.

Based on a copy of the draft bill obtained by Tempo, one of the articles in the draft bill states that a person who committed of non-physical sexual offenses is subject to 9 months of imprisonment. 

According to the draft bill, a person committing non-physical sexual acts aimed at a body, sexual desire, and/or reproductive organs with intent to degrade a person’s dignity based on sexuality can be imprisoned up to 9 months and/or fined up to IDR 10,000,000.00 (ten million Rupiah). 

Another article categorized non-physical sexual harassment as a complaint offense. The Draft Bill defines non-physical sexual activities as statements, bodily movements, or activities that are inappropriate and with a sexual connotation, intended to humiliate the target person.
