TEMPO.CO, Jakarta - The clemency that is planned to be granted to former Jakarta Governor Basuki Tjahaja Purnama or Ahok was recently questioned by Criminal Law Expert Mudzakir.
The criminal law expert from Universitas Islam Indonesia argues that Ahok is currently not serving his sentence at a correctional institution. Ahok has been serving his prison sentence at the Police Mobile Brigade headquarter (Mako Brimob) detention center in Depok.

“Principally, he should serve his sentence at a correctional and not at the Mako Brimob,” said Mudzakir on Monday, December 18.
Ahok’s attorney, I Wayan Sudiarta regretted the expert’s statement and claims that it does not have a strong legal standing. “He is an expert, he should not have said something reckless like that,” said Wayan on Wednesday, December 20.

Wayan also suspects that Mudzakir’s statement is merely an opinion and wishful thinking, “He was the expert who incriminated Ahok [during the trials],” said Wayan. He also presumes that Mudzakir is unaware that the Mako Brimob has its own jail. “There were many people who were
jailed there before Ahok.”
Wayan asserted that the location where the inmate is prisoned, as in this case Ahok, is not legally regulated under Presidential Decree No 174/1999 on Remission.
