TEMPO.CO, Jakarta - The pretrial verdict that favors former Chief of the Supreme Audit Agency Hadi Poernomo had disrupted the Indonesian law enforcement system. According to Mahfud MD, former Chief of the Constitutional Court the decision implicitly declared that cases investigated by investigators working as civil servants are illegitimate.
"The decision did rile up the court system," said Mahfud on Wednesday, May 27, 2015.
The decision declared that the Corruption Eradication Commission has no authority to determine Hadi as a suspect because the Criminal Procedure Code stated that an investigator must have a background experience as police officer or prosecutor.
Mahfud asserted that the decision indirectly questioned the legality of investigators working as civil servants at other government institutions, such as the Marine and Fisheriies Ministry, Law and Human Rights Ministry, and Directorate General of Tax.
"All this time, many judicial institutions processed criminal cases submitted not by the Police and prosecutor. [Does these cases] must be neglected?" Mahfud said.
