KPK Commissioner Says Kaesang has No Obligation to Report Gratification

TEMPO.CO, Jakarta - Deputy Commissioner of the Corruption Eradication Commission (KPK) Nurul Ghufron, stated that the Chairman of the Indonesia Solidarity Party (PSI), who is also the youngest son of President Joko Widodo, Kaesang Pangarep, has no legal obligation to report any gratification.
Ghufron said that concerns on possible gratification must be reported by state apparatus such as the Regent and Governor. Ghufron explained that if a state apparatus received any gratification, then the respective person is obliged to report to KPK to be examined and to be decided whether the gratification will be confiscated or returned to the recipient.
"Your question just now, about (Kaesang), he is not a state apparatus so there is no obligation to report," Ghufron said on Thursday, September 5, 2024.
He added that the KPK has no mechanism to cancel clarifcation on the suspexted gratification in the form of a private jet facility enjoyed by Kaesang. "So if it was later linked to other parties, it is, once again, within the KPK's procedure, in the KPK Law, KPK is passive," Ghufron explained.
If it is proven to be a form of gratification in the coming years, the respective party would have been free of Article 12B of Law No. 20 of 2001 on Eradication of Corruption (Corruption Law)
In relation to question about the use of private jet by the Mayor of Medan Bobby Nasution, Ghufron once again stated that KPK will take a passive stance in receiving reports from state apparatus.
"For example, you are a regent, you are a Mayor, that's what you report to us, we examine it, we don't come to you," Ghufron said.
The case begins with a viral video on social media showing Kaesang and his wife Erina Gudono, who fly using a Gulfstream G650 with flight number N5885SE during their trip to the United States. The genreal public immediately shed the spotlight on the origin of the luxurious facility.
The plane is suspected to be owned by Garena Online, the company that develops the Free Fire mobile game, and is one of the subsidiary of SEA Limited, which also owns Shopee. PT Shopee International Indonesia known to have established a cooperation with the Solo City Government back in 2021, when President Joko Widodo's eldest son, Gibran Rakambuming Raka, was the Mayor of Solo.
