Indonesia's Constitutional Court Lowers Threshold for Regional Head Elections Candidacy

TEMPO.CO, Jakarta - The Constitutional Court (MK) partially granted the Labor Party and Gelora Party’s election threshold lawsuit on Tuesday, August 20, 2024. In its decision, the court allowed political parties or a party coalition without a seat in the Regional Legislative Council or DPRD to nominate a regional head candidate.
The Chief Justice of the Constitutional Court, Suhartoyo, lowered the threshold to nominate a regional head candidate from 25 percent of combined votes in the DPRD legislative election or 20 percent of seats at DPRD.
According to MK, a political party or party coalition may register a candidate in the regional head elections if the following criteria are fulfilled:
a. provinces with final voter list populations of up to 2 million people, participating political parties, or party coalitions must obtain at least 10 percent of valid votes.
b. provinces with final voter list populations of over 2 million people up to 6 million people, participating political parties, or party coalitions must obtain at least 8.5 percent of valid votes.
c. provinces with final voter list populations of over 6 million people up to 12 million people, participating political parties or party coalitions must obtain at least 7.5 percent of valid votes.
d. provinces with final voter list populations of over 12 million people, participating political parties, or party coalitions must obtain at least 6.5 percent of valid votes.
To nominate candidates for regent and vice-regent as well as candidates for mayor and vice-mayor:
a. district/city with final voter list populations of up to 250,000 people, participating political parties or party coalitions must obtain at least 10 percent of valid votes.
b. district/city with final voter list populations of over 250,000 to 500,000 people, participating political parties or party coalitions must obtain at least 8.5 percent of valid votes.
c. district/city with final voter list populations of over 500,000 to 1 million people, participating political parties or party coalitions must obtain at least 7.5 percent of valid votes;
d. district/city with final voter list populations of over 1 million people, participating political parties or party coalitions must obtain at least 6.5 percent of valid votes.
The new threshold is linked to the final voter list in each region. “The Constitutional Court sets four valid votes classifications, namely 10 percent; 8.5 percent; 7.5 percent; and 6.5 percent,” said Labor Party representative Said Salahudin on Tuesday.
