Police to Summon Expert Witness for Bahar Smith Case Next Week

TEMPO.CO, Jakarta - The Police`s criminal investigation unit (Bareskrim) said it will summon expert witness in the case of alleged hate speech and insult to President Joko `Jokowi` by Muhammad Bahar a.k.a Habib Bahar bin Smith, next week.
“It is to strengthen the construction of criminal law in the form of hate speech that went viral on social media,” said the chief of Police`s public relations division Brig. Gen. Dedi Prasetyo at the Police Headquarters, South Jakarta, on Friday, November 30.

Dedi said the expert witness was an expert in criminal law and Electronic Transaction Information (ITE). As for evidence, the video of Bahar’s insult to President Jokowi is still the main evidence. The police continued to look for other supporting evidence.
Bahar bin Smith is suspected to have violated Article 28 (2) in conjunction with Article 45A (2) of Republic of Indonesia Law No. 19/2018 on the amendment of Law No. 11/2008 concerning ITE, as well as Article 4b (2) in conjunction with Article 16 of Republic of Indonesia Law No. 40/2008 concerning Elimination of Racial and Ethnic Discrimination and Article 207 of the Criminal Code with criminal penalties of more than 5 years in prison.
