Jokowi Grants Antasari Azhar`s Clemency Application

TEMPO.CO, Jakarta - State Palace Spokesperson Johan Budi Sapto Pribowo has confirmed that President Joko “Jokowi” Widodo had granted Antasari Azhar’s clemency application. The clemency is currently being processed by the District Court.

“It’s already been sent to South Jakarta’s District Court on Monday. The Presidential Decree said that Antasari’s sentence is reduced by 6 years,” Johan said on Wednesday, January 25, 2017.

Johan did not explain further details on the President Jokowi’s consideration in granting Antasari Azhar’s appeal. He only mentioned that the President referred to the Supreme Court’s deliberation on the basis of his decision.

“One of the reasons is the Supreme Court’s consideration that was sent to President Joko Widodo,” Johan continued.

Coordinator of Antasari Azhar’s legal team, Boyamin Saiman, said that his team would confirm the information to the South Jakarta District Court. “Based on the regulations, the Presidential Clemency Letter is sent through the Chairman of the South Jakarta District Court,” Boyamin said on Wednesday, January 25, 2017.

Previously, Antasari was found guilty of the murder of the PT Rajawali Putra Banjarani Director Nasrudin Zukarnaen in February 2009. He was sentenced to 18 years imprisonment. On September 6, 2011, Antasari submitted an appeal but it was rejected due to not enough evidence.

Since 2010, Antasari received 4.5-year worth of remission. He is currently on parole, where he is required to report once a month to Tangerang’s Class 1 Adult Male Penitentiary. He would be free of any charge by 2022.

Antasari's lawyer explained that the team appealed for clemency to restore his client’s civil rights. He would be unemployed until 2022 and he would not has any civil right. Therefore, Antasari cannot submit any bank loan, would not be able to work in a company and would not be able to own a company or manage a company, Boyamin added.

Currently, Antasari has no political right; he cannot be a member of the House of Representative, submit himself as a regional leader, and cannot be appointed as a Minister or Attorney General.

His previous appeal was nearly granted by President Jokowi but it was hampered by regulations. Currently, the Constitutional Court has revoked the law that regulates the deadline of the appeal.
