All Constitutional Judges Commit Ethical Violation, MKMK Imposes Verbal Warning Sanctions

TEMPO.CO, Jakarta - The Ethics Council of the Constitutional Court or MKMK decided that nine MK judges were proven to have violated the code of ethics and behavior of judges as stated in the Sapta Karsa Hutama greetings, the principles of appropriateness, and decency.
MKMK Chairman Jimly Asshidiqie read the decision directly because all MK judges were proven unable to maintain confidential information in judges' deliberation meetings or RPH. Besides, the MKMK considered that judges were accustomed to the practice of violating conflicts of interest as something normal.
For the violation, the MKMK imposed a collective verbal warning sanction on the reported judges.
The verdict was divided into four parts, namely on Anwar Usman, MK Judge Saldi Isra, MK Judge Arief Hidayat, and the verdict on nine MK judges.
MKMK read the verdict after they checked the parties who reported and those who were reported regarding alleged violations by constitutional judges from Tuesday, 31 October 2023 to Friday, 3 November 2023. From nine judges, Anwar Usman was examined twice since the authorities received the most reports on him.
The nine judges were being reported to MKMK due to allegedly violating ethics when they decided on the minimal age limit of presidential and vice presidential candidates. Of the total 21 reports on constitutional court judges, 15 were aimed at Anwar Usman.
Jimly revealed that all the constitutional judges who granted the lawsuit Number 90/PUU-XXI/2023 on the minimum age limit of presidential and vice presidential candidates were problematic. "We assess the independence of these nine judges one by one," he said at the MK building in Jakarta, on Friday, Nov. 3.
All the constitutional judges were collectively involved in forms of negligence and work culture that allowed ethical violations. In fact, according to Jimly, every constitutional judge cannot influence each other except by common sense.
However, he admitted that Anwar Usman is the judge with the most issues. Anwar's involvement in taking the decision opened the road for his nephew, Gibran Rakabuming Raka, to run as vice presidential candidate for Prabowo Subianto. Meanwhile, the Solo City Mayor is not yet 40 years old.
Jimly said the MKMK read out the decision before the deadline for changing the names of the presidential and vice presidential candidates on Wednesday, November 8, to provide certainty to the public.
