YLKI Concerns with Motorcycle Ban Revocation in Jakarta

TEMPO.CO, Jakarta - Indonesian Consumers Foundation (YLKI) Chief Executive Tulus Abadi is concerned about the Supreme Court`s verdict that canceled the motorcycle ban on Jalan MH Thamrin, Jakarta.

According to Tulus, the rule was needed to manage the traffic chaos that often plagues Jakarta’s roads. “I’m quite concerned with such verdict,” he said Wednesday, January 10.

Furthermore, Tulus said that the Supreme Court made the decision based on the Human Rights Law, although the Transportation Law was the one that was supposed to be used.

The motorcycle ban on Jalan MH Thamrin and Jalan Medan Merdeka Barat were applied during the administration of Governor Basuki Tjahaja Purnama or Ahok. The ban was challenged by two Jakarta residents, Yuliansah Hamid and Diki Iskandar.

In the verdict, the judge stated that Article 2 and 3 of the Jakarta Governor’s Regulation No. 195/2014 contradicted a higher law, which is Article 133 (1) of Law No. 22/2009 on traffic and road transport, Article 11 of the human rights law and Article 5 and 6 No. 12/2011 on the formation of a law.
