Court Denies Setya Novanto`s Pretrial Motion

TEMPO.CO, Jakarta - The South Jakarta District Court has denied a pretrial motion filed by Setya Novanto, the suspect of electronic id cards (e-KTP) corruption case.

“I hereby deny the pretrial motion filed by the applicant,” sole judge Kusno said during a hearing held on Thursday, December 14.

Judge Kusno read the verdict based on Article 82 paragraph 1 of the Criminal Code (KUHP) and the Constitutional Court’s decision on the pretrial motion as informed by expert witness Zainal Arif Muchtar. Zainal said that a pretrial motion would be dismissed when a trial of the case was opened for public.

The pretrial hearing for Setya Novanto was held sooner than the schedule. Earlier, Setya Novanto’s lawyer Ketut Mulya Arsana said he would accept any decision related to the pretrial motion.

“I will leave the decision to the judge. We will respect it,” Ketut said on Wednesday, December 13.

Judge Kusno earlier had recommended Setya Novanto’s legal team to withdraw the pretrial motion as the e-KTP dossiers had been submitted to the Corruption Court. Kusno then explained that the e-KTP graft case trial to be held on Wednesday next week will automatically dismiss the pretrial motion.
