Setya Novanto Pretrial Motion Dismissed as E-KTP Trial Commenced

TEMPO.CO, Jakarta - Mahmud Mulyadi, a criminal law expert from the North Sumatera University, said the pretrial motion filed by Setya Novanto would be considered null and void as his trial related to electronic ID card corruption case has been commenced at the Corruption Court.
According to Mahmud, the pretrial motion would be automatically dismissed when a trial of the case is declared open to the public by the panel of judges, although the trial has not yet indicted the suspect.
“What needs to be done next is to complete the pretrial administration so that it will have a [legal] certainty," Mahmud, who served as an expert witness for the Corruption Eradication Commission (KPK), said during Setya’s pretrial hearing held at the South Jakarta District Court on Tuesday, December 12.

The testimony provided by Mahmud was different from that provided by another expert witness Komariah Emong Sapardjaja presented by the KPK. According to Komariah, Setya’s pretrial motion can be considered null and void after an indictment is read.
Komariah argued that the commencement of the trial for Setya would not be enough to dismiss the pretrial motion. “The examination starts when the indictment is read. When a trial is opened for public, the examination has not yet started,” she explained.
Setya Novanto’s e-KTP graft case trial has been scheduled on Wednesday, December 13. During the last pretrial hearing, Setya’s legal team presented three expert witnesses. Judge Kusno is expected to issue the verdict on Thursday or Friday this week.
