TEMPO.CO, Jakarta - The lawyer of former Jakarta governor Basuki Tjahaja Purnama a.k.a. Ahok I Wayan Sudirta demanded for Buni Yani to be detained immediately after he was charged with the sentence of 1 year and 6 months in case of violation of Information and Electronic Transaction Act.
"The court must immediately execute and detain Buni Yani," Wayan told Tempo on Tuesday, November 14, 2017.
According to Wayan, Buni Yani should be arrested immediately after the verdict was read because Buni Yani has been proven guilty of tweaking Ahok`s statement and publish it in social media.
The Panel of Judges of the Bandung District Court handed down the verdict on Tuesday, November 14th 2017, for assessing Buni Yani proven to violate Article 32 Paragraph 1 of the ITE Act. Chairman of the Bandung District Court, Judge Saptono, mentioned in the verdict that the defendant Buni Yani was proven to intentionally and without rights or against the law in any way, in altering, adding, subtracting, transmitting, destroying, removing, moving, concealing an Electronic Information or electronic document belong to others or public property.
The judge did not detain Buni Yani because Buni Yani immediately appealed after the verdict was read. "Because there is a legal effort, this decision has not been a permanent legal decision," said Judge Saptono.
Ahok was sentenced to 2 years imprisonment on May 9th 2017 for an alleged blasphemy of religion in accordance with Article 156a of the Criminal Code. At that time, Ahok was arrested and only on May 22nd 2017 Ahok canceled his appeal which meant he accepted the sentence.
"Ahok was arrested immediately after the verdict, why doesn't Buni Yani (got arrested immediately) also?" Wayan Sudirta said.
Ahok's case stems from a video clip of his speech in the Thousand Islands in September last year that was spread on the internet. Ahok visited the Thousand Islands to disseminate the grouper fish cultivation program. However, Ahok's tongue slipped during a speech by citing Al-Qur'an verses of Al-Maidah verse 51. From that 40 minutes of Ahok's speech duration, the video that went viral was only a 13-second, this 13-second cut was then being debated.
Ahok's other lawyer, Teguh Samudra, opined that the judge's verdict is far from predicted. In the trial, Ahok's statement, seen as a whole, did not make any kind of blasphemy act against any religion, it should be the opposite because Ahok's statement had been edited by Buni Yani. "People are smart and able to judge which are fair and unjust," stated Teguh.
