No Court Mechanism In Disbanding Problematic Mass Organization

TEMPO.CO, Jakarta - By issuing the government regulation in lieu of law No 2 (2017) on mass-organizations, Indonesian State Officials will be granted the authority to disband mass organizations, such as Hizbut Tahrir Indonesia (HTI), without having to go through a court mechanism.
State Officials will be able to disband any organizations by revoking its permit which will be executed by state agencies that originally issued the permit.

Coordinating Minister of Political, Legal, and Security Affairs, Wiranto, said that the change was done because officials consider the previous Law on mass-organization (UU Ormas) is unable to prevent organizations from spreading ideologies that contradict the state ideology.
This means that the agency that issued the original permit is also given the authority to revoke or cancel an organization’s permit which is given to the Ministry of Human Rights and Legal Affairs and the Home Affairs Ministry.
“We will have legal support to act whenever there are mass organizations that are clearly endangering the country’s ideology by contradicting it,” said Wiranto.

Despite not going through a court mechanism, the process of disbanding an organization will have to pass through several stages.
HTI considers the perppu as a form of government arrogance and suggested that by erasing the court mechanism, the government has chosen to openly act unjustly.
