TEMPO.CO, Tangerang-The judicial panel of Tangerang District Court considers that the rape and murder of Eno Farihah were premeditated. The plan involved defendant RAI, 15, and two other suspects, Rahmat Arifin and Imam Harpriadi. “The elements of premeditated [murder] are met,” chief judge R.A. Suharni reads the verdict, Thursday, June 16, 2016.

Suharni considers that RAI, together with Rahmat Arifin and Imam Harpriadi, planned the murder within a very short time. Yet, it has met the elements of premeditated murder. “They met each other and came to the victim’s room, together they assaulted the victim in the room.”

The premeditation to kill the victim was illustrated in Imam’s remarks that told RAI to take a knife for murdering Eno, Suharni says. However, failing to find a knife, RAI took a hoe instead. “Quick, kill her, if she’s not dead, we will get caught,” Imam told RAI, as read by the judicial panel.

The hoe was used to kill Eno. “The victim was killed from bleeding to her abdomen and chest caused by the hoe handle,” Suharni says. Aside from meeting the elements of premeditated murder, the judicial panel also sees that the elements of intent and joint liability are met.

Under the considerations, the judicial panel have sentenced RAI to 10 years in prison. The maximum sentence for the juvenile is in accordance with what the prosecutors had sought. The judges consider RAI’s acts as sadistic and inhumane. RAI has been found guilty of violating Article 340 of the Criminal Code on premeditated murder.
