Komnas HAM: Cebongan Attack No Serious Violation

TEMPO.CO, Jakarta The National Human Rights Commission (Komnas HAM) says the Cebongan Penetentiary attack in Sleman, Yogyakarta, does not constitute a violation of human rights.

"This case cannot be brought to human rights court yet," Komnas HAM chair Siti Noor Laila said yesterday (4/11).

According to Noor, to be considered as a gross violation of human rights, a crime must be proven to have been well planned, systematic and widespread. Only serious human rights violations are heard at the human rights court. Minor and medium violations are processed in the general court or a court-martial if the offenders are soldiers.

Defense Minister Purnomo Yusgiantoro also said that the Cebongan attack was not a human rights violation. He said that there were no orders from the higher-ups to raid the prison.

"We decided that this does not need to go to human rights court," he said.

Commission for Missing Persons and Victims of Violence (Kontras) head Haris Azhar said he was disappointed by Komnas HAM's conclusion as it obscures the facts of the Cebongan tragedy.

"They have no intention to investigate this case," said Haris.
