Legal Aid Condemns the Passing of Job Creation Perpu Into Law

TEMPO.CO, JakartaChairperson for Indonesian Legal Aid Foundation (YLBHI) Muhammad Isnur on Sunday asserted that the political maneuver by the current administration in issuing the Job Creation regulation in lieu of law (Perpu) and the subsequent passing into law by House legislators is a brutal attack against the principle of rule of law. 

“The law insists that in order to issue a Perpu, there must be a sense of emergency. Where is this sense of emergency?” Isnur said as Tempo met him outside of the House of Representatives (DPR) headquarters on March 26.

He insists that such an emergency is nonexistent, especially considering the process of formulating the Job Creation Perpu took more than a year. Members of the House’s approval also came three months after. 

“There is no sense of emergency whatsoever,” he said. 

As previously reported, the passing of this law has sparked widespread protests from the public which peaked in the law being challenged at the Constitutional Court (MK). During this process, the MK deemed Law No.11/2020 on Job Creation to be formally defective and issued a verdict deeming it ‘conditionally unconstitutional.’

The government has been ordered to fix the Job Creation law through public participation, but instead of fixing the troubled law, the government instead issued the job creation regulation in lieu of the law and was passed by members of the House in a plenary held on March 21, 2023. 

YLBHI’s main criticism against the law is the law’s focus on the interests of investors over the public interest.
