Manpower Ministry to Take Legal Action Regarding Deadly Clash at PT GNI

TEMPO.CO, Jakarta - The Ministry of Manpower (Kemnaker) will take legal action if PT Gunbuster Nickel Industry (GNI) is proven to not comply with the Indonesia Labour law. Both from the aspect of work or team norms as well as Occupational Health and Safety (K3/OHS). This was the aftermath of a clash between employees in PT GNI on Saturday, January 14, 2023, which caused the deaths of two workers.
"This incident will be a lesson for the workforce in the future," said the Director-General for Supervisory Development of Manpower and OHS at Kemnaker, Haiyani Rumondang in a written statement, quoted by Tempo, Thursday, January 19, 2023.
"We want to prevent similar incidents from happening again and to create harmonious industrial relations at PT GNI," he added.
Haiyani said the Labor Inspectorate Team and Mediator for Industrial Relations at the Ministry of Manpower had started to collect data. Inspections were also carried out to obtain in-depth information regarding the cause of the riots among workers at PT GNI, especially those related to labour issues.
According to Haiyani, his team is coordinating with the Department of Labour of North Morowali, Morowali Regency, and Central Sulawesi to obtain further information. Afterwards, the team held a meeting with the company's management of PT GNI to request clarification on the labour issues that were being demanded by the unions.
The developed information included demands for implementing K3 procedures in companies, completeness of workers' protective equipment, company regulations, clarity on wage deductions, Fixed Term Employment Agreement (PKWT) for permanent workers, and hiring union members whose contracts have been terminated. Afterwards, demands to install air circulation in every warehouse or smelter, and clarify the rights of workers who died late last year.
“Apart from requesting an explanation from the company's management, our team directly observed the conditions in the field, including the location where the riot occurred. We conduct this to obtain comprehensive information," said Haiyani.
