Criminal Code on Adultery Feared to Repel Investors, Tourists; Govt Clarifies

TEMPO.CO, Jakarta - The Law and Human Rights Ministry’s acting director general of legislation Dhahana Putra in a press release on Wednesday clarified that the recently passed Criminal Code (KUHP) will not potentially repel foreign investors due to its provisions many deemed oversees morality and intrusive towards society’s private aspect. This fear was mentioned by United States Ambassador to Indonesia Sum Kim at the US-Indonesia Investment Summit on Tuesday.
The Ambassador highlighted that the aforementioned aspects within the KUHP will potentially affect Indonesia’s investment climate.
“It would be untrue if the provisions in the Criminal Code regarding private spaces or morality would potentially drive investors and international tourists away from Indonesia,” Dhahana wrote in a statement to Tempo on December 7.
Articles 412 and 413 of the Criminal Code will punish anyone who commits cohabitation and adultery. However, the law also writes that those who have the right to file a police complaint, in this case, are the spouses who are bound by marriage. Parents, or children for people who are not bound by marriage.
No legal processes will follow through without complaints as those who have the right to are people directly affected by the act of cohabitation and adultery. Dhahana said the provision is meant to respect marriage institutions as mentioned under Law No.1/1974.
