House Legislator to Push for a Democratic Criminal Code Draft Bill

TEMPO.CO, Jakarta - The House of Representatives (DPR) Law Commission and the Ministry of Law and Human Rights are set to discuss the final draft of the Criminal Code Bill (RKUHP) on Thursday. Member of House Law Commission legislator Taufik Basari to Tempo implied that they will discuss crucial aspects of the Bill and accommodate the input from members of the public.

As widely reported, many believe the draft bill contains provisions that are threatening the democratic nature of the country such as provisions overseeing treason, attacks on the President’s honor and dignity, and contempt against a state institution and general power. 

“As far as I can observe. There is a positive development within the House Commission III. Pressuring for changes on these provisions have grown stronger after lobbies and discussion with fellow Commission III legislators were held,” Taufik wrote in a text message to Tempo on November 24.

Urging to Drop Undemocratic Provisions 

The NasDem Party faction legislator assured that the provisions that are potentially undemocratic will be urged to be dropped or at least be revised. He hopes the pressure within the House will suffice to entice the government to agree on producing a Criminal Code Draft that is democratic. 

Other provisions he eyes to criticize in the final draft discussion include those overseeing customary laws that can potentially violate the legality overseen by the penal code. 

"Input from the community has previously been accommodated by the government in the last draft on November 9. However, some issues remain that still could potentially become problems,” he said.
