Labor Party Urges Heru Budi to File Cassation over Minimum Wage

TEMPO.CO, Jakarta - The Labor Party asked the Acting Governor of Jakarta Heru Budi Hartono to file a cassation appeal against the Jakarta State Administrative High Court’s (PTTUN) ruling which rejected the Jakarta government’s appeal regarding the provincial minimum wage or UMP 2022.

“The Labor Party and KSPI (Confederation of Indonesian Trade Unions) hope that Bapak Heru Budi as the Acting Governor of Jakarta will file an appeal to the Supreme Court against the PTTUN’s ruling,” said Labor Party President Said Iqbal in a written statement, Thursday, November 17, 2022.

The PTTUN rejected the appeal filed by the provincial government under the leadership of Governor Anies Baswedan and ruled in favor of the Jakarta Employers' Association (Apindo) lawsuit, setting the city’s minimum wage at Rp4,573,845 which is lower than stipulated in the Governor’s Decree at Rp4,641,852.

Said Iqbal said he would meet Heru Budi to convey the matter as the year is ending soon and there will be a UMP determination for next year. “The wages have been paid, and 2022 is about to finish. If we are asked to return the paid excess wages, the workers will surely ‘be mad’,” he added.

The 2022 UMP, he went on, is also vital as a reference for determining the hike in the 2023 UMP. “Now, if you want to decide on the 2023 UMP (DKI), why use based on, UMP PTUN whose value is smaller? Even though what is paid (is) the UMP that the governor has decided before," he said.

If Heru Budi is not willing to file a cassation appeal, Said Iqbal underlined that workers will do so.

Apart from that, Said also asked business players to continue paying the Jakarta minimum wage according to Governor Anies Baswedan’s Decree because the PTTUN's decision did not have permanent legal force yet. “If entrepreneurs dare to lower the Jakarta UMP, we will take it to legal process,” he said.
