Ministry Postpones Trademark Registration of Gojek-Tokopedia's GoTo

TEMPO.CO, Jakarta - The registration application of a trademark GoTo, the merged entity of Gojek and Tokopedia, is still afoot, said the Ministry of Law and Human Rights’ Directorate General of Intellectual Property amid the trademark dispute.
The Intellectual Property DG, however, temporarily put off the process following the lawsuit filed by PT Terbit Financial Technology for the use of its brand’s name.
“We are waiting [for the court’s ruling] because we don't want to contradict it,” said DG official Agung Indriyanto to Tempo on Thursday, November 11.
Gojek and Tokopedia announced a merger and established GoTo on May 17, 2021. Terbit Financial Technology reported the two unicorns to Jakarta Metro Police for allegedly violating trademark rights on October 13, 2021, and filed a lawsuit at the Central Jakarta Commercial Court on November 2, 2021.
In response to the lawsuit, GoTo Corporate Affairs Astrid Kusumawardhani said that her side was ready to face Terbit Financial at the court.
Agung went on to explain that the brand’s name was not a license. "But please bear in mind that using a brand sans prior registration was using without a right, meaning it is prone to this sort of issues," Agung said.
