Alleged Sexual Harassers in KPI Cannot Countersue Victim: LPSK

TEMPO.CO, Jakarta - The Witness and Victim Protection Agency (LPSK) said alleged perpetrators in the sexual harassment case in the Indonesian Broadcasting Commission (KPI) had no legal basis to countersue their victim, MS. The KPK employee publicly revealed that he was bullied and sexually harassed by his colleagues at the office.
“First, there is no clear criminal basis for filing a report over experiencing cyber bullying in cyberspace. The legal subject is unclear, who will be reported? The victim or the people who commit the bullying?” said LPSK Deputy Chairman Maneger Nasution on Wednesday, September 8.
The report will become unclearer if the subject is the victim. Besides, in the legal construction of witness and victim protection, Maneger explained that victims or reporters of alleged sexual harassment should not be able to be prosecuted legally.
“Witnesses, victims, witnesses from perpetrators’ side, and/or reporting parties cannot be prosecuted for their testimonies and or reports that will be, are being, or have been given unless the testimony or report is not conveyed in good intention,” he explained.
Maneger asserted that MS is the victim who is actually trying to help law enforcement in uncovering the sexual harassment case. “His efforts and courage should be appreciated because as a citizen he is actively helping law enforcers to uncover sexual harassment,” he said.
