BSNP Dissolved, Jokowi Urged to Revise National Education Standards Regulation

TEMPO.CO, Jakarta - Education expert, Doni Koesoema, has urged President Joko "Jokowi" Widodo to revise Government Regulation Number (PP) 57 of 2021 concerning National Education Standards.

"I urge President Joko Widodo as the leader of the government and Nadiem Makarim as the Minister of Education and Technology to revise PP (government regulation) Number 57 of 2021," Doni said in his statement, Tuesday, August 31, 2021.

He said the existence of the National Education Standards Agency (BSNP) legally no longer exists since the issuance of Government Regulation Number 57 of 2021 concerning National Education Standards.

Doni explained that the existence of BSNP as a standardization body is regulated in PP No. 19 of 2005. The PP and the two amendments to it were revoked and replaced by PP 57. However, said Doni, PP 57 does not contain articles governing standardization bodies. In fact, Article 35 paragraph 4 of the National Education System Law (Sisdiknas) mandates the existence of a standardization, guarantee, and quality control body for education to be regulated in PP.

In fact, Article 34 of PP 57 only cites Article 35 paragraph 3 of the National Education System Law, and the regulation of the standardization body is directly submitted to the minister. Therefore, according to Doni, this is contrary to the mandate of the National Education System Law.

The 2003 National Education System Law article 35 paragraph 3 states that "The development of national education standards as well as monitoring and reporting on their achievements nationally shall be carried out by a standardization, assurance and quality control body for education".

The National Education System Law Article 35 paragraph 3 states that "The education standardization, guarantee, and quality control body is independent at the national and provincial levels."

Because they are contradictory, Doni considers that the articles in Presidential Regulation Number 62 of 2021 concerning Kemendikbudristek and Permendikbudristek Number 28 of 2021 which regulate standardization bodies must be revised and reorganized.

Doni said that revisions could be made by adding articles on regulations concerning standardization, assurance, and quality control bodies of education as an independent and professional body.

Minister of Education, Culture, Research, and Technology Nadiem Makarim previously dissolved BSNP. The dissolution of the BSNP is stated in Permendikbudristek Number 28 of 2021 concerning Organization and Governance of the Ministry of Education and Culture. Article 334 states that with the enactment of the ministerial regulation, Permendikbud Number 39 of 2019 concerning BSNP is revoked and declared invalid.
