DPR Legislators' Maximum Term Under MK's Judicial Review

TEMPO.CO, Jakarta - A number of legislators in the House of Representatives (DPR) argue against the rule overseeing a legislator’s maximum term in office following a request for judicial review in the Constitutional Court (MK) regarding the matter. 

A member of House’s law commission from the United Development Party (PPP), Arsul Sani, asserts that he will respect the judicial review but maintains that no other country in the world limits the maximum tenure of a state legislator. 

“The main function of a parliament member is to conduct legislation, not executive matters, no other country has put a limit to this,” said Arsul on Thursday, January 16.

Arsul compares the notion to the United States Congress who are able to stay in office for seven terms, and even until their death. He argues that a House member’s term is an open policy that is based on lawmakers’ decisions. 

Echoing Arsul’s statement, House's head of the Prosperous Justice Party faction, Jazuli Juwaini on Wednesday argues that the legislative and executive positions have different contexts. “If a regional head can be a king, the DPR can't. That’s the contextual difference.”

The maximum tenure for a DPR legislator is currently under the Constitutional Court’s material test by the advocate Ignatius Supriyadi, who thinks that the articles contained in the Legislative Institutions (MD3) Law goes against the 1945 Constitution’s Article 28D.
