TEMPO.CO, Jakarta - Coordinating Minister of Politics, Law, and Security Affairs Mahfud MD asserts that a lawful country is only tasked to do two things; creating law and implementing the law. However, the former Constitutional Court chief justice said in practice, the implementation is still lackluster.
“Problems often arise in conceiving the law. There are laws that are commoditized, the Articles are passed due to requests, those things exist,” said Mahfud MD upon opening the public event at the Hotel Aryaduta in Jakarta today.
The law, he says, is a middle ground to maintain democracy and prevents the country from dwelling into anarchy. “Nomocracy emerges between democracy and anarchy. You are free to speak your mind but that is overseen by law under a democratic process.”
Other than legal commoditization, Mahfud MD also mentioned Indonesia’s overlapping laws that are being the sole focus of President Jokowi’s final term in office.
In the level of legal implementation, Mahfud MD acknowledges that it is still far from just due to legal formalities blocking its way and the existence of a small number of egotistical authorities.
