Legal Experts Says Jokowi Not Worth Support

TEMPO.CO, Jakarta - State Administrative Law expert Bivitri Susanti expressed her disappointment when President Joko "Jokowi" Widodo stated that he is reluctant to issue Government Regulation in Lieu of A Law concerning the Corruption Eradication Commission (Perpu KPK). Bivitri asserted that a leader that does not support corruption eradication should not be supported.
"For me, a leader that does not support corruption eradication efforts is not worth support," Bivitri said when contacted by Tempo on November 20, 2019.
Bivitri is one of the figures whose opinion was requested by Jokowi in relation to the issuance of Perpu KPK. A meeting between the president and 41 figures was conducted at the State Palace on September 26, 2019. The meeting was held following waves of college student protest in a number of cities to refuse the amendment of the Corruption Eradication Commission law and issuance of another Law draft.
After the meeting, Joko Widodo stated that he will consider the issuance of the Perpu. However, the intention was changed following a meeting with leaders of political parties on September 30, 2019.
Bivitri said that she is still optimistic that the government regulation that can weaken the KPK will be issued following Widodo's inauguration as the President on October 20, 2019. Other figures in the closed meeting with the president shared the same optimism. They shared the same optimism that Jokowi will wait until political conditions are cooling down
However, Bivitri said that all hope is gone when the president said that he does not want to issue the regulation because the KPK Law is currently under the examination at the Supreme Court.
"We must respect thee processes. Not to happen that there is someone who is still under the material examination and then immediately burdened with a new regulation. I think we need to know manners in state administrative processes," Joko Widodo said during a dialog with journalists of the State Palace on November 1, 2019.
Bivitri asserted that Jokowi's argument was baseless and said that he can still issue a Government Regulation in Lieu of a Law despite the fact that the lawsuit against the KPK Law is still being examined by the Constitutional Court. "So it is not true that issuing a Perpu is inappropriate. It is totally not true," she said.
