TEMPO.CO, Jakarta - The Jokowi - Ma’ruf Amin national campaign team (TKN) believed that the Constitutional Court (MK) will deny the appeal filed by Prabowo - Sandiaga team concerning the presidential election dispute.
The TKN’s legal and advocacy director, Ade Irfan Pulungan, explained there are four considerations behind his team’s optimism. First; the claims presented by the plaintiff concerning structure, systematic, and massive election fraud were weak.
“We conclude that their claims presented to MK that read at that time (trials) are very weak to MK’s authority that is regulated in Election Law and MK regulation,” Ade Irfan explained.
Secondly, pieces of evidence presented to MK had no correlation with the concerned dispute. “Many evidence from the plaintiff is in the form of the news report on mass media,” he added.
Ade Irfan mentioned that Prabowo legal team drew a number of evidence that had been submitted to MK because the advocate failed to present needed evidence in the hearings. “Evidence of C1 Forms from several provinces were also withdrawn during trials,” he said.
Moreover, Prabowo team brought witnesses who had no relation with the case. “The witnesses did not fulfill the witness criteria, people who directly see, hear, or involved in an event.”
The last consideration was that expert witness from Prabowo team did not explain information regarding the issue to MK. “They only talked about final voters list (DPT) and Situng (KPU’s vote count information system), which is apparently not an official tool in determining the final vote by KPU (Election Commission). The official result of vote tally is based on manual, tiered calculation,” Ade concluded.
