Former Pertamina CEO Karen Agustiawan Get 8 Years;AGO Mull Appeal

TEMPO.CO, Jakarta - The Attorney General's Office (AGO) is still contemplating whether they would appeal the Corruption Court's sentence to former Pertamina CEO Karen Agustiawan. The court's decision to send Karen to eight years in prison, is less than what the prosecutors demanded. 

Prosecutors wanted Karen to be put behind bars for 15 years, plus a Rp1-billion fine—substitutable to an additional prison time of 6months. They also demanded Rp284 billion in damages, substitutable to 5 years of imprisonment.  

On Monday, June 10, the court sentenced Karen Agustiawan to 8 years in prison plus a fine of Rp1bn—substitutable to an additional imprisonment of 4 months.

"We are still thinking it through—whether to appeal or not," the AGO's head of legal information center, Mukri, said on Tuesday, June 11. As regulated by law, all parties are given 7 days to respond to the court's decision.

The court ruled that Karen Agustiawan, former president director of Pertamina (2009-2014), is guilty of ignoring investment procedures during the acquisition of a participating interest (PI) in Basker Manta Gummy (BMG) block in Australia in 2009. Karen is assesses of investing without prior discussions and reviews, and making decision without the approval of Pertamina's board of commissioners as well as the company's legal division.

Karen Agustiawan's actions are blamed for a state loss of Rp568 billion, while it enriched Roc Oil Company Australia. Karen was also found guilty of practicing corruption together with Pertamina's finance director Federick ST Siahaan; its merger and acquisition manager Bayu Kristanto, and legal consul and compliance officer Genades Panjaitan.

Frederick and Bayu had been sentenced to 8 years each while Genades's status is still a suspect.
