Minister Sofyan Djalil Reported to Police over HGU Data

TEMPO.CO, JakartaThe civil society coalition reported Agrarian and Spatial Planning (ATR) Minister Sofyan Djalil to the National Police’s (Polri) criminal investigation unit following the latter’s rejection to publish data on land cultivation right (HGU).

“We report the minister for deliberately closing HGU data that is considered as public information,” said the advocacy head of the Indonesian Legal Aid Foundation (YLBHI), Era Purnama Sari, in the Police Headquarter, South Jakarta, on Monday, March 25.

The coalition arrived at 11:00 local times, and the report was officially issued under No. STTL/221/III/2019 Bareskrim dated March 25, at 20:30 WIB.

However, the minister was not listed as a reported person in the notion but the Papua National Land Agency (BPN). Era explained that the matter was just a mere technical issue because the report was initiated from cases in Papua. “The case development will see a possibility to reach the minister,” she added.

Papua BPN was asked to disclose information on HGUs belonging to 31 companies. On May 28, 2018, the Papua Information Commission's decision confirmed the disclosure of information about the 31 companies' HGUs. But the decision was not executed.

Sofyan Djalil also stated that he refused to disclose the document by reason of endangering national interests. "In this case protecting the oil palm industry," Era added.

Era assessed that Sofyan Djalil did not comply with the final verdict of the HGU dispute, asserting that HGU information was public information.

YLBHI also sent a demand letter to Minister Sofyan Djalil on March 11, 2019. "This report is a form of public disappointment over the community's lack of seriousness in overcoming agrarian conflicts in Indonesia," Era concluded.
