Ahmad Dhani Files Appeal Upon 1.5-year Sentence in Jail

TEMPO.CO, JakartaThe legal team of Ahmad Dhani planned to file an appeal of South Jakarta District Court’s ruling Thursday, January 31. The musician, who is recently active in politics, was sentenced to 1.5-year imprisonment on the hate speech case earlier Monday.

“We will submit documents tomorrow (January 31) to file an appeal in South Jakarta District Court at ten a.m,” said Ahmad Dhani’s attorney, Hendarsam Marantoko, via a short message, Wednesday, January 30.

Ahmad Dhani was charged with Article 45 (a) in conjunction with Article 28(2) of Law on Electronic  Information and Transactions Law (ITE). The judge Ratmoho stated that Ahmad Dhani was found guilty of spreading information meant to create hate or spark hostility in the society based on a certain ethnicity, religion, and race or known as SARA through his Twitter account.

Hendarsam assessed that the sentence was an act of revenge against his client following the jail sentence of former Jakarta Governor Basuki Tjahaja Purnama or BTP in a blasphemy case back in 2017.

According to him, the judge should have clearly explained things or words referred to as hate speech that contain racial violence, instead of ruling based on assumption during the legal proceedings of Ahmad Dhani.

“The judge only relies on subjective interpretations [for the ruling], without providing legal argumentative,” Hendarsam added.
