TEMPO.CO, Jakarta - Setya Novanto’s lawyer, Friedrich Yunadi, expressed his objection against the Corruption Eradication Commission (KPK) for arresting his client who is still undergoing treatment due to a car accident.
However, legal expert Bivitri Susanti stated that Friedrich’s statement is deemed inappropriate and causes public confusion.
Friedrich previously declared that Setya Novanto cannot be investigated nor arrested due to his medical condition and treatment. Regarding such matters, Bivitri explained that a suspect can still be arrested by undergoing certain procedures in accordance with the regulations from the Supreme Court.
”If a suspect is sick, an arrest can still be carried out in which the suspect is detained in the hospital and his detainment period is not accounted for,” Bivitri clarified in Menteng, Central Jakarta, on Saturday (18/11).
Bivitri added that what the KPK did was a legal action and does not violate human rights as claimed by Friedrich. Bivitricontinued that investigation, arrest, or detainment are imposed equally to anyone regardless of their position as a part of upholding a just law.
She further reminded that coordination from relevant parties is needed to monitor this case. She also believed that one of such measures is to report Setya Novanto’s lawyer to Indonesian Advocate Association (Pradi).
“Not only by means of memes, but also by filing a report to Pradi,” Bivitri added.
