Ridwan Kamil to Send Legal Notice to Zoo Operator

TEMPO.CO, Bandung-Bandung Mayor Ridwan “Emil” Kamil said Bandung administration will soon send a legal notice to Yayasan Margasatwa Tamansari, the operator of Bandung Zoo. “We have held a meeting with lawyers from Unpad and [we] have concluded that a legal notice sould soon be issued,” he said on Monday, May 30, 2016.

Emil said the legal notice will be sent to Yayasan Margasatwa Tamansari for its fault of leasing zoo area to vendors and some fast food restaurants. The lease was carried out without notice to Bandung administration as the asset owner.

According to Emil, Yayasan Margasatwa Tamansari is the leasee of the zoo area. The foundation should notice Bandung administration if they intend to lease the area to any third party. “They lease [the land] from us from the beginning. So they have to notice us [of any re-lease],” he said.

Emil said the legal notice will be sent by the Department of Finance and Regional Asset Management (DPKAD) Bandung as asset owner proxy. He hoped that the foundation could cooperate to resolve any dispute outside the court system.

According to the Mayor, the legal notice may still be resolved through consensus between Bandung administration’s laywers and those of Yayasan Margasatwa Tamansari. “It would be better to discuss and resolve it with only a legal notice,” he said.

Emil explained, if the first legal notice is ignored, the second and third legal notice will be sent subsequently. According to him, in addition to resolving lease issue, people’s expectation may be responded by improvements in Bandung Zoo facilities by meeting the minimum standards of animal walfare.

“We send a legal notice on the basis of three issues, namely lease issue, the status of the foundation that make a profit, and involvement of third party,” Emil said.

In addition, Yayasan Margasatwa Tamansari has not paid its rent since 2007.
