TEMPO.CO, Jakarta - The South Jakarta District Court has granted the pre-trial lawsuit submitted by former Chief of the Supreme Audit Agency Hadi Poernomo against his status as a suspect in a corruption case. Haswandi, the judge who presides Hadi's trial declared that Hadi Poernomo's case cannot be included as a crime.
"Granted the pre-trial [lawsuit] partly. Declared that the investigation by the [Corruption Eradication Commission] and the determination of the plantiff as a suspect was illegal because the investigation does not have a legal standing," said Haswandi during the reading of the decision on Tuesday, May 26, 2015.
Haswandi also instructed the Corruption Eradication Commission (KPK) to stop its investigation against Hadi. In addition, Haswandi stated that any determination or decision issued by the KPK are illegal.
In his legal consideration, Haswandi stated that cases related to taxes are special crimes and cannot be included as a conventional crime. Haswandi also stated that Hadi's case is an administrative case, not a corruption case.
Another provision stated by Haswandi in his decision was that the KPK is not allowed to recruit independent investigators. Instead, the anti-corruption commission must appoint investigators from other government institutions.
